In 1997 werden in Nederland en Belgi\u00eb de magische truffels ge\u00efntroduceerd en over de verkoop werd het lage belastingtarief geheven, zoals dat bij voedingsmiddelen ook gebeurt. Daar kwam echter verandering in.\u00a0Magische Paddenstoelen<\/a> <\/em>die gebruikt worden vanwege hun hallucinerende eigenschappen zijn geen voedingsmiddelen maar genotsmiddelen en vallen dus niet onder het verlaagde btw-tarief. Smartshop-eigenaren waren het er niet mee eens gingen hiertegen in beroep. Bovendien leek de Hoge Raad er ook anders over te denken in 2014.<\/p>\n\n\n\n

Voedingsmiddelen of genotsmiddelen?<\/h2>\n\n\n\n

Het lage 9% tarief zou moeten gelden voor de truffels die een smartshop verkocht, zo vond de eigenaar. Maar helaas pindakaas in een vorige week gepubliceerde uitspraak wordt hij in het ongelijk gesteld door de Rechtbank in Den Haag. De zogeheten magische truffels vallen volgens de rechter niet onder de definitie van voedingsmiddelen, zo oordeelt de rechtbank.<\/p>\n\n\n\n

Het zijn dus genotsmiddelen. En de verkoop daarvan wordt belast met het algemene tarief -lees: hoge- van 21%. De Belastingdienst volgde dat standpunt al sinds 2019, net zoals we dat bij Wapwinkel deden overigens. Onlangs oordeelde de rechtbank Gelderland in een vergelijkbare zaak hetzelfde.<\/p>\n","protected":false},"excerpt":{"rendered":"
